1. Introduction

Welcome to Samoku (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Samoku website, applications, and AI-powered document preparation services (collectively, the “Service”). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

Samoku is an AI-powered document preparation platform that generates professional letters on your behalf, including medical bill negotiation letters, parking ticket appeals, security deposit recovery letters, and freelancer payment recovery letters. Each letter is generated using artificial intelligence trained on publicly available legal information and successful negotiation strategies.

Samoku is not a law firm and does not provide legal advice. The documents generated through our Service are informational tools based on publicly available statutes, codes, and best practices. They do not create an attorney-client relationship. For specific legal advice regarding your situation, consult a licensed attorney in your jurisdiction.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and not share them with third parties.
• Promptly update your account information if it changes.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or remain inactive for an extended period.

5. Payments and Pricing

Certain features of the Service require a one-time payment. All prices are listed in US dollars and are displayed before you complete a purchase. Prices may change with reasonable notice, but changes will not affect previously completed purchases.

Payments are processed through Stripe, our third-party payment processor. By making a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details on our servers.

6. Refund Policy

Refund requests may be submitted within 7 days of purchase if the generated document is materially defective or does not match the description of the Service. Because our documents are digitally delivered, refunds may not be available after the document has been downloaded. Refunds are issued at our reasonable discretion. 7. Acceptable Use

You agree not to use the Service to:

• Generate fraudulent, misleading, or dishonest documents.
• Impersonate another person or misrepresent your identity or situation.
• Violate any applicable local, state, national, or international law.
• Interfere with or disrupt the Service or its underlying infrastructure.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Resell, redistribute, or commercially exploit generated documents or access to the Service.

8. Intellectual Property

All content, design, graphics, trademarks, and intellectual property on the Service are owned by or licensed to Samoku. You may not reproduce, distribute, or create derivative works without our prior written consent.

Documents generated for you are licensed for your personal use. You may use, modify, and send the generated documents for their intended purpose (e.g., sending a negotiation letter to a medical provider). You may not resell or commercially exploit generated documents.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee any specific outcome from using our generated documents, including but not limited to the reduction of bills, dismissal of tickets, or recovery of funds. Results depend on your specific circumstances, the recipient of the letter, and many factors outside our control.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Samoku and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Samoku and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
